These Terms and Conditions (hereinafter "Terms") govern access to and use of the website postura.ai (hereinafter "the Site") published by Postura, a simplified joint-stock company (SAS) with a share capital of EUR 10,000, registered under number [RCS to be completed], with its registered office at 10 rue de Penthièvre, 75008 Paris, France (hereinafter "the Company").
Article 1 – Purpose
These Terms define the conditions under which users (hereinafter "the User") may access and use the Site and the services offered by Postura, including registration on the waitlist, browsing product information, and contacting our teams.
Article 2 – Access to the Site
The Site is freely accessible to any user with an Internet connection. The costs of accessing the service (hardware, Internet connection) remain the responsibility of the User. The Company uses reasonable means at its disposal to ensure quality access to the Site, but is under no obligation of result. The Company reserves the right to suspend, limit, or interrupt access to the Site for maintenance purposes or for any other reason, without incurring any liability.
Article 3 – Waitlist Registration
The User may register on the waitlist by providing their email address. By registering, the User agrees to receive communications from Postura regarding product progress, exclusive offers, and Company news. The User may unsubscribe at any time by clicking the unsubscribe link in each email or by contacting info@postura.ai.
Article 4 – Intellectual Property
All elements of the Site (text, images, graphics, logos, icons, sounds, software, etc.) are the exclusive property of the Company or its partners and are protected by French and international intellectual property laws. Any reproduction, representation, modification, publication, transmission, or distortion, in whole or in part, of the Site or its content, by any means and on any medium, is prohibited without the prior written authorization of the Company.
Article 5 – Liability
The Company endeavors to provide information as accurate as possible on the Site. However, it cannot be held responsible for omissions, inaccuracies, or deficiencies in updating such information. The Company disclaims all liability for any direct or indirect damage resulting from access to or use of the Site, including unavailability, data loss, deterioration, or viruses that may affect the User's computer equipment.
Article 6 – Personal Data
In accordance with the General Data Protection Regulation (GDPR) and the French Data Protection Act, the Company collects and processes Users' personal data with respect for their privacy. Data collected (email address upon waitlist registration) is processed for the purpose of sending information and commercial communications. The User has the right to access, rectify, delete, and port their data, as well as the right to object to and limit processing. To exercise these rights, the User may contact the Company at info@postura.ai.
Article 7 – Hyperlinks
The Site may contain hyperlinks to other websites. The Company has no control over these sites and disclaims all responsibility for their content, privacy policies, or practices. The User accesses these third-party sites at their own risk.
Article 8 – Governing Law and Jurisdiction
These Terms are governed by French law. In the event of a dispute relating to the interpretation or performance of these Terms, the parties shall endeavor to find an amicable solution. Failing that, the competent courts of Paris shall have sole jurisdiction.
Article 9 – Amendments to the Terms
The Company reserves the right to modify these Terms at any time. The modified Terms shall take effect upon their publication on the Site. The User is invited to consult the Terms regularly to stay informed of any changes.
